Executor Services

What this is, and why you may need it:

Upon the passing of an individual, the wishes outlined in their Will must be followed. This is often a complicated and time-consuming task, taking multiple years. Coda Trust can take on the responsibility of administering an estate by working with your close network of family and professional advisors. We ensure that your instructions are carried out in a timely and equitable manner, without any conflicts of interest or disharmony that often come with appointing a family member as an Executor.

You can appoint us as a sole Executor, Co-Executor, Alternate Executor, or Agent for Executor, depending on the level of involvement and responsibility that you wish for us to take on.

What we will do:
  • Collaborate with family members to assist with any funeral and immediate financial needs
  • Identify and value all debts and assets held by the estate and re-register them in the name of the estate
  • Safeguard the assets of the estate, including any insurance or investment needs
  • Publish advertisements for creditors and pay all proven debts of the estate
  • Manage the application to the Court for Probate
  • File tax returns for the estate and the final tax returns for the deceased, and obtain tax clearance certificates
  • Obtain approval from beneficiaries, heirs-at-law or the Court for accounts showing assets, receipts, disbursements and distribution of the estate
  • Set up any ongoing trusts established in the Will
  • Sell assets as necessary, and distribute the estate to beneficiaries
  • Deal with any legal claims against the estate

Trustee Services

What this is, and why you may need it:

Establishing and maintaining a trust can be a helpful tool to achieve different goals you may have, such as passing assets to beneficiaries gradually, caring for a child or individual without financial independence, or having an unequal distribution of assets to your beneficiaries. Coda Trust can act as a neutral third-party in the role of Trustee to ensure that the proper ongoing administrative work is completed.

We can take on the responsibility of establishing and maintaining your trust by working with any other Trustees you appoint, to ensure that your intentions behind the trust are carried out in an efficient and organized manner. This takes the burden off family members who may not have the time or expertise to adequately meet the fiduciary responsibilities that acting as Trustee entails.

It is important to grant a Power of Attorney in the event that you become incapable of managing your financial affairs in the future. The role of Power of Attorney can take a significant amount of financial knowledge, energy, and time. Having to balance this commitment while also caring for a loved one can be overwhelming – Coda Trust can take on this role so that your family can focus on spending time with their loved ones.

You can appoint us as a Power of Attorney, Alternate Power of Attorney, or Agent for Attorney, depending on the level of involvement and responsibility that you wish for us to take on.

Often when a family member or friend is appointed as an Executor, Trustee, or Financial Power of Attorney, they can find themselves overwhelmed by the stress, emotional burden, and time being consumed by their duties. Additionally, many friends or family members who have been appointed may not have the knowledge or expertise to perform their duties with confidence.

In these cases, Coda Trust can work alongside the appointed individual as an Agent. We provide the individual with guidance and take on the administrative responsibilities of the role, while leaving the individual with full legal capacity as Executor, Trustee, or Power of Attorney. We keep the individual informed of the process each step of the way.
